Dropshipping Agreements

Launching a dropshipping business? We’ve got the Dropshipping Agreements and associated documents you’ll need to get started!

Dropshipping is a booming industry, particularly thanks to Tim Ferris’ book the 4 Hour Work Week. With the advent of new technology solutions there are some great opportunities for emerging entrepreneurs to get a taste for business. Now whether you’ve read our page on Dropshipping legal requirements or not, you’ve probably landed here because you’re aware that there are some key Dropshipping Agreements you need in order to protect your interests and in order to operate a successful business.

That’s where we here at IT Lawyers Brisbane come in!

We’ve developed our Dropshipping Agreement Packages to give you access to affordable documents that are tailored to your business and give you what you need to hit the ground running feeling confident that your interests are protected.

From having helped numerous dropshipping businesses (whether they’re using Oberlo, AliExpress and/or Shopify) and knowing the laws around Online Advertising in Australia, we understand the industry and what your Dropshipping Agreements need. Although a lot of the tools we’ve mentioned come with standard form agreements, these agreements are often drafted in overseas jurisdictions which don’t comply with Australian law and can get businesses in a lot of trouble! Even where they are tailored to the Australian jurisdiction, they often require amendments in order to make them applicable to the dropshipping model, which we are sure you understand is different to other e-commerce models.

We offer the below packages to cater to a number of dropshipping structures and needs. Contact us regarding your requirements and we will help to get you on your way!

Privacy Policy

As discussed in our Dropshipping legal requirements page, you may potentially be exempt from the requirements of the Privacy Act 1988 (Cth). However, despite this, more and more consumers are privacy conscious and do expect their service providers to have in place privacy policies which they can view and confirm how their personal information is handled. That’s why we’ve included a Privacy Policy in all our Dropshipping Agreement Packages!

Our Dropshipping Privacy Policy gives you some fundamental privacy terms and have been drafted in the context of the Australian Privacy Principles. This type of dropshipping legal document should help guide you on responsible handling of personal information and also provide transparency to your customers.

Customer expectations are not the only reason why we include a Privacy Policy. Suppliers, including tech giants like Apple and Facebook, require you to have a Privacy Policy when consuming their services, such as the Apple App Store or Facebooks advertising platform.

Website Terms and Conditions

The core component of our Dropshipping Agreement Package is our Website Terms and Conditions. There are a number of different considerations when you venture into dropshipping including how your terms of sale will operate, compliance with the Australian Consumer Law and any intellectual property rights involved.

Our Website Terms and Conditions help you navigate all of these in the context of dropshipping. Having well drafted terms and conditions is a crucial component of your Dropshipping Agreements in order to protect your interests and that’s why we’ve included it in all our packages.

Standing Supplier Agreement and Sales Order Form

Where your transaction values are high or you’re engaging directly with suppliers, it may be prudent for your business to have in place written contracts with your suppliers. These take the form of a Standing Supplier Agreement and related Sales Order Form.

Considering the risks involved with dropshipping, having clear Dropshipping Agreements with your suppliers can protect your interests by ensuring everyone is on the same page as to where rights and responsibilities lie.

Company Registration

You may have read on our Dropshipping legal requirements page that there are a number of options for structuring your dropshipping business. The structure we normally end up recommending to our clients is to have a company. This is due to the level of protection it gives you by separating you personally from the liability of your business. It also adds the flexibility to introduce new business partners, to help you run the business or raise further capital.

If you do decide to operate your dropshipping business as a company, you can select one of our Dropshipping Agreement Packages which include a Company Registration. Our Company Registration component will have us set up your company, includes all the initial documents you need to set up including your company constitution. The prices shown below is inclusive of your ASIC registration fee!

An important note…

Our Dropshipping Agreement Packages are intended for early-stage or small-scale dropshipping businesses, particularly those that use established methods with the likes of Shopify, Oberlo and AliExpress. We wanted to create a package that helps you get started in an affordable and efficient way while covering your essential legal needs.

If you’re a large-scale dropshipping business or handling high value or large volumes directly with suppliers, these documents probably won’t satisfy your needs. But never fear! IT Lawyers Brisbane are experienced with dropshipping at all levels. Give us a call for a free initial consultation to discuss your business and see how we can create documents that suit your specific needs.
